Data Sharing Agreement
Between His Majesty the King in right of Canada, as represented by the Minister of Natural Resources Canada, acting through the Canadian Forest Service (CFS), and the Requester
Data means the following Data, or any part thereof:
- Stand descriptions (location, coordinates, experiment description);
- Tree characteristics (species, height, diameter-at-breast height, health status);
- Sample characteristics and growth ring widths (sampling height, total number of rings, ring widths, ring years);
Under this Data Sharing Agreement (the “Agreement”), the parties agree to the following terms and conditions:
- CFS is the lawful owner of the Data. CFS allows the Requester to use it, notwithstanding that CFS will retain the exclusive ownership of the Data and the right to update, distribute, market, sell, or otherwise utilize the Data at its sole discretion.
- The Requester acknowledges and agrees that all information pertaining to the Data is to be kept strictly confidential and shall be available only to the Requester. No such information shall be disclosed to third parties or released into the public domain without the prior written consent of CFS.

The Requester will acknowledge the contribution of CFS in providing the Data as follows:
- TreeSource should be acknowledged as follows: TreeSource (treesource.rncan.gc.ca), with the date of Data access;
- CFS-TRenD should be cited as follows: Martin P. Girardin, Xiao Jing Guo, Juha Metsaranta, David Gervais, Elizabeth Campbell, André Arsenault, Miriam Isaac-Renton, Jill E. Harvey, Jag Bhatti, and Edward H. Hogg. 2021. A national tree-ring Data repository for Canadian forests (CFS-TRenD): structure, synthesis, and applications. - While every effort has been made to accurately collect, compile and produce Data and products, no warranty, expressed or implied, is made regarding the accuracy or utility of the Data for general scientific purposes. It is strongly recommended that careful attention be paid to the contents of the metadata files associated with the Data. It is the professional responsibility of scientific investigators to understand and appropriately use the Data inputs to their analyses.
- Data are subject to numerous updates and revisions without notice. Users should consult CFS to obtain the most current and official version of any Data or products, and record the version number of Data or the date that these were accessed. Any modification of NFI Data or other products by authorized users or their collaborators involves risk of corruption, and is not sanctioned by CFS.
- For parts of the Data, plot locations (e.g., NFI plots) are strictly confidential. Approximate plot location information may be provided to authorized users that require such information for analytical purposes. Special permission is required to gain access to precise plot locations. This information must be treated in strict confidence and not shared with any other parties for any purpose. No attempt should be made to visit individual plots.
- Data are provided “as is”, and CFS excludes all representations, warranties, obligations, and liabilities, whether express or implied, to the maximum extent permitted by law. CFS is not liable for any errors or omissions in the Data, and will not under any circumstances be liable for any direct, indirect, special, incidental, consequential, or other loss, injury or damage caused by its use or otherwise arising in connection with the Data, even if specifically advised of the possibility of such loss, injury or damage.
- This Agreement shall be governed by the laws in force in the Province of Quebec.
